AUDIOVISUAL PROFESSIONAL GUIDE ® EXPOSES:

What Audiovisual Professional Guide ® (hereinafter ” GA “), is the name and brand of a mobile application and web app of public access, where users and consumers, can consult the contact data of companies and professionals of the audiovisual sector that are given of high on the hiring platform.

In both platforms, the owner of GA has space enabled for the free publication of personal contact data of audiovisual technicians, and advertising space, for the insertion of advertising by third parties through banners or similar for audiovisual companies that so wish with rates according to the type of publication, specified in clause 1 these Terms and Conditions.
That the owner of GA, commercializes in its platforms and social networks, spaces and advertising services for entrepreneurs, merchants, industrial and professional, legal or physical persons, (hereinafter the client), for the purposes of their commercial, industrial or professional activity , so that their clients do not have the status of consumers and users.
That the client is interested in appearing in GA and in all its social networks and / or in the contracting of advertising services or products, be it an advertising banner or similar for the purposes of its commercial, industrial or professional activity, which they are commercialized in the GA, which accepts, in order to establish a contractual framework that regulates the order.
That by virtue of the foregoing, the client has agreed to accept the following clauses

CLAUSES

FIRST.- OBJECT OF THE TERMS AND CONDITIONS AND RATES APPLICABLE TO THEMSELVES

Customers can choose between the following modalities:

Option 1: The free appearance in GA in the case of being an audiovisual technician, in up to 3 different professional categories that may be demonstrable at GA’s request.
Option 2: The appearance in GA and its social networks, with or without the hiring of an advertising space, for the publication of a banner or similar, being able to appear the data as a company supplier in up to 3 different categories, in accordance with the established in Option 1 of this clause, in the section or sections marked below and for the amount that will be indicated by electronic mail that will be sent to the contact address used at the time of registration and which will be signed with the corresponding contract of advertising:

Full-screen advertising when starting app and web app for 6 months (1)

Second and successive full screen advertising passes when starting app and web app 6 months (1)

Full-screen advertising when you start app and web app 12 months (1)

Second and successive full screen advertising passes when starting app and web app 12 months (1)

This modality includes appearance in the directory of companies.

The client, if applicable, must make the payment for appearance in the guide, at the time of signing the contract, being able to use the following payment methods: Credit Card, Bank Account Debit or Bank Transfer.

SECOND - PRICE (ONLY FOR COMPANIES)

The price of the chosen sections, which will be informed prior to the signing of the corresponding contract, do not include indirect taxes that are applicable in each case, established in the Spanish legal framework, and have for all purposes the character of closed, can not GA or the customer claim any amount for services that have not been contracted.

In the event that the client resolves the contract mentioned in the previous paragraph, the latter undertakes to pay all the amounts that are still pending payment.

During the year 2019, the amounts are reduced by 25% while maintaining the launch offer of 2018. For new additions in 2020, and renewals, the amount will be increased by 5% in 2020, 5% more in 2021, and so on.

THIRD. - DURATION OF THE COMMERCIAL RELATIONSHIP BETWEEN THE CLIENT AND GA

The duration of the business relationship for professional clients will be 1 year from registration in GA.

The duration of the business relationship for business customers can be 6 or 12 months.

In any of the modalities, the business client may choose between a single semiannual or annual payment, or in its case, pay it for monthly payments.

Whichever payment method is chosen by the client, he must remain in the service during the contracted period of time.

In the business relationship for business customers, the client has a free monthly subscription at the end of the subscription, and the current month at the time of discharge, with the launch promotion of 2018 (12 + 1)

After the expiration of the applicable term, the contract shall be renewed by tacit renewal for similar periods, unless either party sends a formal communication consisting of a bureaufax addressed to the other Party at least 30 calendar days in advance to the date of effect of the renewal of the contract, indicating its intention to terminate the contractual relationship.

QUARTER. - CONTRACTED PUBLICITY SPACES AND FORMATS

In the event that the client contracts advertising in full screen when starting app and web app, said advertising will appear during the time it takes to start the application.

The format and size that the client must provide for said space will be a .JPG or .GIF file in high quality in a size of 720 x 1080 pixels. (recommended to a quality of 72 PP)

In the event that the client contracts advertising on the screen of the search engine, the app and the web app, said advertising will appear during the time the user is in said section.

The format and size that the client must provide for said space will be a .JPG or .GIF file in high quality in a size of 720 x 220 pixels (recommended at a quality of 72 PP)

GA, reserves the right to rescale the banner that is specified if necessary, in a format that can be adapted to the space designed for it.

FIFTH - CESSION OF RIGHTS

The customer, during the validity of the commercial relationship, agrees to expressly assign to GA all the rights that may correspond to the exhibition or reproduction of any image of the published advertisement or profile image that is collected in the GA, waiving the collection of any amount that may accrue for said concepts and for its use for commercial and promotional purposes of the GA in any media, discovered or undiscovered, and in any format or medium.

SEVENTH - GA’S OBLIGATIONS

GA undertakes to provide the services with complete diligence and professionalism and in accordance with the provisions of these Terms and Conditions, to insert the contact information and publish the advertising delivered by the client on the platforms, committing to publish the information and the advertisement with the described characteristics, in the agreed place and throughout the duration of the commercial relationship. GA can deny the inclusion of certain advertisements provided that they contain or may infringe rights of third parties, constitutional principles or against public morals. This valuation will be in the hands of GA and will be communicated to the client as soon as possible. Likewise, GA undertakes not to use the material delivered by the customer for any other use that is not stipulated.

EIGHTH - OBLIGATIONS OF THE COMPANY CLIENT

It undertakes to make the payment of the corresponding amounts according to what is established in the provision regarding the economic conditions and typologies, by means of the payment method indicated in the contract that is formalized. It is obliged to provide in time, with a maximum term of five days from the hiring and following the form established in the fourth clause and with the guarantees of the fifth clause, the advertisement that you want to include in GA, and in the specific format specified .

Guarantees to GA that it has all the rights of intellectual or industrial property with respect to the advertisement provided, as well as that said announcement does not infringe the rights of third parties, constitutional principles or public morals.

Guarantees to GA that the preparation of advertising complies with the regulations regarding advertising, services of the information society, consumers and users, competition law, as well as any other regulations that may be applicable.

The client undertakes to indemnify GA for all those damages that may be caused by the insertion of the advertisement in accordance with the provisions of the contract that is formalized or the annulment thereof.

Failure of payment by the customer of any of the amounts to which it is bound by virtue of the contract that is formalized, will lead to the cessation of advertising services and services arranged by GA, automatically producing the resolution of the aforementioned contract .

NINTH - DATA PROTECTION

To access the services that GA offers through its platforms, the client must provide some personal data. In compliance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, regarding the protection of natural persons with regard to the processing of personal data and the free movement of personal data. we inform you that by filling in these forms, your personal data will be incorporated and will be treated in GA databases, in order to be able to provide and offer our services as well as to inform you of GA’s improvements. Likewise, we inform you of the possibility of exercising the rights of access, rectification, deletion, opposition, limitation, portability, forgetting and not being subject to automated decisions of your personal data, free of charge by sending an email to rgpd@guiaprofesionalaudiovisual.es or at the address avd. Juan Pablo II, nº11, of Pinto, Madrid, CP 28320 must submit a copy of his ID in his application

GA declares to know and expressly comply with the European and Spanish legislation on data protection, undertaking to process the data obtained in accordance with said regulations. Specifically, GA is obliged to:

Ensure compliance with all necessary technical and organizational measures in order to ensure the security of personal data, preventing alteration, loss, or unauthorized access.
Collect the personal data object of treatment complying with the applicable legislation on Data Protection.

In what is not foreseen in these Terms and Conditions, the provisions of the GA Privacy Policy will be followed.

TENTH- CONFIDENTIALITY

All information, whether data, databases, procedures or documents that are exchanged in any format or medium will be treated by the party that receives them with absolute confidentiality, obliging not to disseminate, deliver or assign them under any title or use they for purposes other than those agreed in these Terms and Conditions. The obligation of confidentiality will remain in force indefinitely after the resolution of the commercial relationship.

ELEVENTH - INTELLECTUAL PROPERTY

All material delivered by the customer to GA, including graphics, logos, slogans, etc .; It is the property of the client, and it is material that may be protected by the rules of intellectual and industrial property, being forbidden its use by GA, for any purpose other than that regulated in these Terms and Conditions, as well as by any other third party. The client is responsible for any type of claim that could be mediated by third parties claiming a right of intellectual or industrial property to the content of the advertisement.

TENTH TWO- RESPONSIBILITY

GA will be exclusively responsible in the cases of not fulfilling the provision of the service, term and form stipulated in the Present Terms and Conditions.

GA shall not be liable in any case for any other type of damage, of any nature or class, that may arise from the insertion of the advertising material in its computer supports, non-compliance or delays due to force majeure, or that are beyond its control , as well as any breach of data protection that is not attributable to GA.

GA may temporarily suspend access to the platform due to maintenance, repair, update or improvement operations. However, whenever the circumstances permit, GA will inform the client, sufficiently in advance, of the scheduled date for the suspension of the services.

In particular, GA reserves the right to eliminate, limit or prevent access to its platform when technical difficulties arise due to events or circumstances beyond GA that, in its sole discretion, reduce or cancel the standard security levels adopted for the proper functioning of the platform.

In any case, GA is committed to solving the problems that may arise and offering all the necessary support to the client to reach a quick and satisfactory solution of the incident.

TENTH THIRD- MODIFICATION

The Terms and Conditions that are published at the moment in which the client accesses this Platform are understood as valid.

If any provision of these Terms and Conditions is declared inapplicable or invalid, such provision shall be limited or eliminated to the minimum extent necessary so that the remaining conditions and obligations remain in full force and effect and must be complied with.

GA may delete, modify or substitute the contents of this document at any time, by posting a notice on its websites or by sending a notification through the Platform or by email.

FOURTH QUARTER - COURTS

These general conditions are governed by Spanish Law. The parties submit, at their own discretion, for the resolution of conflicts and renouncing any other jurisdiction, to the courts and tribunals of the user’s domicile. Furthermore, as an entity adhering to Online Confidence and under the terms of its Code of Ethics, in the event of disputes related to online contracting and advertising, data protection and protection of minors, the user may resort to the Online Confidential Dispute Resolution System (www.confianzaonline.es)

And proof of conformity and for this to be recorder for the appropriate purposes, the client accepts these Terms and Condicions.
